Clients retain ownership of files, drawings, models, designs, and intellectual property submitted to Hippoproject SRL.
By submitting materials, the client confirms that they possess all necessary rights to use, reproduce, modify, and manufacture those materials.
The client assumes full responsibility for any copyright, trademark, patent, design, or intellectual property infringement arising from submitted materials.
Hippoproject SRL shall not be liable for intellectual property disputes relating to client-provided files.
7. Hippoplus Intellectual Property
During the quotation, design, engineering, and project development process, Hippoproject SRL may create:
- Design concepts
- Product ideas
- Sketches
- CAD models
- Renderings
- Visualizations
- Technical drawings
- Engineering solutions
- Manufacturing methodologies
- Production documentation
- Technical specifications
- Cost calculations
Unless otherwise agreed in writing, all such materials remain the exclusive intellectual property of Hippoproject SRL.
The presentation of these materials does not transfer ownership, reproduction rights, manufacturing rights, licensing rights, or commercial usage rights to the client.
8. Restrictions on Use
Without prior written authorization from Hippoproject SRL, clients may not:
- Copy or reproduce our concepts;
- Share proposals with third parties;
- Use our designs to obtain competing manufacturing quotations;
- Manufacture products based on our designs;
- Modify or commercialize our concepts;
- Reuse engineering solutions developed by Hippoproject SRL.
Any unauthorized use may result in legal action and claims for damages.
9. Transfer of Intellectual Property Rights
Ownership and usage rights relating to custom designs, technical documentation, and project deliverables transfer only when:
- A quotation or agreement has been accepted;
- All contractual obligations have been fulfilled;
- Full payment has been received;
- Transfer of rights is confirmed in writing where applicable.
Unless explicitly stated otherwise, Hippoproject SRL retains ownership of all manufacturing know-how, methodologies, production techniques, and proprietary processes.
10. Orders and Production
Production begins only after:
- Written approval of the quotation;
- Approval of drawings or technical specifications where applicable;
- Receipt of any required advance payment.
Clients are responsible for verifying all dimensions, specifications, approvals, and project details before production begins.
Any changes requested after approval may result in additional costs and revised delivery schedules.
11. Manufacturing Variations
Due to the nature of custom manufacturing and large-scale 3D printing, minor variations may occur, including:
- Surface texture differences
- Layer visibility
- Color variations
- Material appearance differences
- Minor dimensional tolerances
Such variations shall not be considered defects unless expressly agreed otherwise in writing.
12. Delivery and Installation
Estimated delivery dates are provided in good faith but are not guaranteed unless expressly agreed.
Delays caused by:
- Client approvals
- Design revisions
- Material shortages
- Transportation issues
- Force majeure events
shall not create liability for Hippoproject SRL.
Risk transfers to the client upon delivery unless otherwise agreed.
13. Rental Services
Where products are rented, clients are responsible for:
- Proper handling and use;
- Protection against theft, loss, and damage;
- Returning products in substantially the same condition as delivered.
Additional charges may apply for repair, replacement, cleaning, transportation, or late return.
14. Rent-to-Own Programs
Where a rent-to-own arrangement is offered:
- Ownership remains with Hippoproject SRL until all agreed payments are completed.
- Failure to meet payment obligations may result in termination of the agreement and recovery of the product.
- Specific conditions may be governed by separate contractual agreements.
15. General Warranty
Unless otherwise agreed in writing, Hippoproject SRL warrants that products supplied will be free from defects in materials and workmanship at the time of delivery.
The warranty applies only to defects resulting directly from manufacturing or material faults under normal and intended use conditions.
The warranty does not cover:
- Normal wear and tear;
- Cosmetic changes resulting from aging or environmental exposure;
- Improper handling or storage;
- Improper installation performed by third parties;
- Misuse or abuse;
- Vandalism;
- Accidental damage;
- Impact damage;
- Fire, flood, storms, or other force majeure events;
- Unauthorized repairs, modifications, or alterations;
- Damage resulting from use outside the intended purpose of the product.
Where a valid warranty claim is accepted, Hippoproject SRL may, at its sole discretion:
- Repair the product;
- Replace the defective component;
- Replace the product;
- Provide an appropriate credit or refund.
Any warranty claim must be reported within a reasonable period after the defect is discovered.
16. Worry-Free Warranty
For selected products and projects, Hippoproject SRL may offer an enhanced commercial warranty program referred to as the Worry-Free Warranty.
Where explicitly included in a quotation, agreement, invoice, or product documentation, the Worry-Free Warranty extends beyond the standard warranty and may provide repair or replacement coverage even when damage is not caused by manufacturing defects.
Depending on the specific offer, the Worry-Free Warranty may include protection against:
- Accidental damage;
- Breakage during normal use;
- Damage caused by clients, guests, visitors, or event participants;
- Damage occurring during the agreed warranty period.
The exact duration, scope, exclusions, and conditions of the Worry-Free Warranty shall be specified in the relevant quotation, contract, invoice, or warranty certificate.
Unless expressly stated otherwise, the Worry-Free Warranty does not cover:
- Theft or disappearance;
- Intentional destruction;
- Damage resulting from illegal activities;
- Damage caused by unauthorized structural modifications;
- Damage occurring after the warranty period has expired.
Hippoproject SRL reserves the right to inspect any claimed damage before approving repair or replacement under the Worry-Free Warranty.
The Worry-Free Warranty is a voluntary commercial benefit and does not limit or replace any mandatory legal rights available to customers under applicable law.
17. Portfolio and Marketing Rights
Unless otherwise agreed in writing or restricted by confidentiality obligations, Hippoproject SRL reserves the right to:
- Photograph projects;
- Film installations;
- Create renderings and documentation;
- Publish completed work on websites, social media, exhibitions, presentations, marketing materials, and promotional campaigns.
Where reasonably possible, confidential client information will not be disclosed.
18. Confidentiality
Hippoproject SRL will use reasonable efforts to protect confidential information received from clients.
Confidential information will not be intentionally disclosed to third parties except:
- Where necessary for project execution;
- To professional service providers under confidentiality obligations;
- As required by law.
19. Limitation of Liability
To the maximum extent permitted by law, Hippoproject SRL shall not be liable for:
- Indirect damages;
- Consequential damages;
- Lost profits;
- Business interruption;
- Loss of data;
- Delays caused by third parties or circumstances beyond our control.
Our total liability shall not exceed the amount paid by the client for the specific product or service giving rise to the claim.
